WatchmakerRep general terms and conditions for watch repair, maintenance, valuation and related services.

2. Definitions

Service provider: WatchmakerRep, the watchmaker providing the services.

Client: the customer who receives the services or products.

Services: all work including repair, maintenance, valuation or sale of watches and related items.

Products: all goods supplied by the service provider, including watches, parts and accessories.

3. Applicability

These terms and conditions apply to all quotations, orders, agreements and deliveries of the service provider. Deviations are only valid if agreed in writing.

4. Quotations and prices

All quotations and price indications are non-binding unless otherwise stated. Prices are inclusive of VAT unless otherwise indicated. Additional work will be charged separately.

5. Execution of the order

The service provider shall carry out the order to the best of its insight and ability but cannot guarantee full restoration of damage unless expressly agreed in writing. If parts are no longer available, the service provider may use equivalent replacement parts.

6. Delivery times

Stated delivery or repair times are indicative and do not constitute a strict deadline. Exceeding a deadline does not entitle the client to compensation or dissolution of the agreement.

7. Warranty

7.1. A warranty of 3 months applies to repairs carried out and parts replaced, unless otherwise agreed.

7.2. The warranty lapses if:

  • the client carries out modifications or repairs themselves;
  • there is improper use, water damage or impact damage.

8. Liability

The service provider is only liable for damage that is the direct result of an attributable failure. Any liability is limited to the amount paid out in the case in question by the liability insurance, plus the excess. The service provider is not liable for indirect damage such as consequential loss, loss of profit or emotional damage.

9. Payment

Payment is due upon collection of the watch unless otherwise agreed. If the client does not pay in time, the service provider is entitled to charge statutory interest and collection costs.

10. Retention of title and right of retention

All products supplied remain the property of the service provider until the client has paid in full. The service provider has the right to retain the watch until full payment, including any additional costs, has been received.

11. Complaints

Complaints about work carried out must be reported in writing within 14 days of discovery. If a complaint is justified, the service provider will carry out the work properly or offer an appropriate solution.

12. Governing law and jurisdiction

Dutch law applies exclusively to all legal relationships. Disputes shall in the first instance be submitted to the competent court in the district where the service provider is established.
